The carriage of a Guest is subject to SpiceJet regulations relating to the conditions of Non-International Carriage (Passenger and Baggage) framed in accordance with The Carriage by Air Act, 1972 and Notification regarding application of the Carriage which is non-international. These regulations are known as SpiceJet Non-International Carriage (passenger and baggage) Regulations 1992. The liability of the company for damage sustained in the event of the death or wounding of a passenger or any other bodily injury suffered by a passenger or by his registered baggage during the course of carriage by air will be governed by the provisions of sections 4,5,6 and the rules contained in the Second Schedule of Carriage by Air Act 1972 with certain exceptions, adaptations, modifications, etc. as notified in the Govt. of India, Ministry of Civil Aviation Notification and as amended from time to time. All disputes shall be subject to jurisdiction of Delhi only.

SpiceJet is a ticket less airline. An itinerary does not constitute a document of carriage. The Booking in the SpiceJet database is the primary record of carriage and in the event of any differences between the itinerary and the Booking in the SpiceJet database, the Booking will prevail.

  1. All Guests, including children and infants, must present valid identification at check-in. It is your responsibility to ensure you have the appropriate travel documents at all times.
  2. Check-in starts "2 hours" before scheduled departure, and closes 45 minutes prior to the scheduled departure time. Guests are requested to report at least 2 hours prior to departure time, at SpiceJet Check-in counters.
  3. Cancellation / Changes within "2 hours" of departure or failure to check-in for a SpiceJet flight at least 45 minutes prior to the scheduled departure time will result in the fare being forfeited.
  4. Schedule is subject to change and regulatory authority approvals.
  5. Guests may carry a maximum of one piece of cabin baggage, as defined by BCAS guidelines, with an additional restriction of maximum weight of one piece of 10.0 kg, not to exceed 55cm + 35cm + 25cm (Total 115 cm). Due to airport security regulations, no cabin baggage is allowed on any flights originating from Jammu and Srinagar airports.
  6. SpiceJet allows its Guests to check-in up to 20 kg of luggage, not to exceed 158 cm in overall dimensions (L+W+H), per paying passenger. Baggage in excess of 20 kg is subject to a fee (Rs.100 per Kg) to be paid at the airport at check-in. SpiceJet will accept excess baggage if space permits. SpiceJet may refuse to carry any luggage that does not comply with its policies.
  7. Any spicy promotional / auction fare purchased in conjunction with return fare cannot be cancelled or changed.
  8. Where bad weather or instances beyond SpiceJet control has resulted in your flight being cancelled or delayed, SpiceJet will try to assist you to get to your destination, but will not be liable in any way for the delay or cancellation.
  9. SpiceJet assumes no liability for wear and tear to luggage (scratches, torn zippers, straps, wheels, handles, scuffs, dents, soiling or manufacturer defects).
  10. SpiceJet does not connect to other airlines; therefore, SpiceJet is not responsible for any losses incurred by our Guests while trying to connect to or from other airlines.
  11. The consumption of alcohol on board is strictly prohibited.
  12. SpiceJet reserves the right to refuse passage to any passenger that is under the influence of alcohol or drugs, or where SpiceJet believes it is necessary for the safety and comfort of you or other Guests or for the protection of property.
  13. Smoking is not permitted on any SpiceJet aircraft.
  14. SpiceJet highly recommends that you remove all valuables (cameras, jewelry, money, electronics, perishables, etc.) and medication from your check-in luggage and place them in your carry-on. SpiceJet will not accept responsibility for these items.

    In case, the passenger decides to carry any valuables in their checked-in baggage against the above advice; they will do this at their own risk and shall not hold SpiceJet responsible for any pilferage / damage / etc. to such valuables. They shall lay no claim against SpiceJet, its employees, agents, successors etc in this regard.

  15. Guests will be subjected to a security screening prior to boarding the aircraft. This is mandatory per Indian Regulations.
  16. The company reserves to itself the right, without assigning any reason, to cancel or delay the commencement or continuance of the flight or to alter the stopping place or to deviate from the route of the journey or to change the type of aircraft in use without thereby incurring any liability in damages or otherwise to the passengers or any other person on any ground whatsoever. The Company also reserves to itself the right to refuse to carry any person whom it considers unfit to travel or who in the opinion of the company may constitute risks to the aircraft or to the persons on board.
  17. If at any stage it is found that the aircraft with the booked load or passengers will be over loaded, the Company will have the right to decide which passengers or articles shall be off-loaded and such decision shall be binding.
  18. The Company is not liable for any loss or damage occasioned by delay in the carriage by air of passengers or baggage. Receipt without complaint of registered baggage on the termination of the journey shall be prima facie evidence that the baggage has been delivered correctly and in good condition.
  19. The Carrier's liability for loss or damage to baggage is limited to Rs 200 per kg with a maximum of Rs 3000 only. The Carrier assumes no liability for fragile or perishable articles.
  20. The reservation itinerary issued by the Company shall be subject to rules of cancellation made by the Company for the time being in force, which may be seen at our website www.spicejet.com or at our offices on request.
  21. In the event of death of a passenger, or any bodily injury or wound suffered by a passenger which results in a permanent disablement incapacitating him from engaging in or being occupied with his usual duties or business occupation, the liability of the Carrier for each passenger shall be Rs 750,000 only if the passenger is 12 years or more of age and Rs 375,000 if the passenger is below 12 years of age on the date of the accident.
  22. Children under the age of 12 require adult accompaniment at all times. SpiceJet will accept children aged between 5-12 years traveling alone as unaccompanied children (as per UNMR inventory). SpiceJet does not charge any fee for this service. Guests should complete and sign an Unaccompanied Minor Form at the departing airports.
  23. SpiceJet shall not be liable for any damage(s) resulting from acts of error or omission in timetables or other published schedules, representations made by its employees, agents or representatives with regard to the date and/or time of departure/ arrival or operation of any flight except in cases where it is proved that the intention is to cause such damage.
  24. SpiceJet sells snacks/refreshments and juices on selected flights. Water is provided free of cost on all flights of SpiceJet.
  25. Infants under the age of 2 years, and not occupying a seat, are subject to a fee of Rs. 521 plus the government PSF of Rs.229 and Government service tax of Rs.53.
  26. The use of wheelchairs is limited to only 4 guests per flight, which needs to be booked in advance through our guest Sales & Service Reservation center. There is no charge for this service. SpiceJet also offers appropriate assistance to blind passengers.
  27. Sports/Skiing equipment will be treated as a Check-in baggage, and Excess baggage rules apply for any additional weight.
  28. For every booking on the basic fare there would be fuel charge depending on the sector flown, a Government fee (PSF), a Government service tax and in addition applicable UDF/ADF will be charged.
  29. Spicy Code: Spicy codes are specific codes given out to our Guests to obtain a discount as and when certain promotional activities are carried out by SpiceJet. When a promotion occurs on SpiceJet, these Spicy Codes are given out to our Guests and/or Travel Partners through E-Mail or SMS, which may be used on the website to avail discounts on the basic fare.

    Conditions:

    • Every spicy code is active for only a certain period of time.
    • Some spicy codes may be restricted to only Travel Partners/ Specific Travel Partners or may be given out to all our Guests.
    • Certain low fares may be excluded from these spicy code promotions.
    • Discount may be a fixed or a percentage value and the amount of discount may vary with every promotional activity.
    • Discount may or may not print on the Itinerary subject to the specific conditions of the promotional activity.
    • During the promotional activity, spicy codes can be used for any number of PNRs/Passengers.
    Usage:

    During the booking process, on the payment page, you would be given an option of entering the Spicy Code. On entering this Spicy Code and clicking Continue, the effective discount will be applied and reduced from the basic fare. Now, you can make the balance payment as per the payment options available on the site.
  30. Foreign (Non-Indian) Credit Card Acceptance:

    SpiceJet accepts payment for tickets through the use of Foreign Credit Cards. SpiceJet currently accepts Visa, MasterCard and American Express. The credit card needs to be shown at the airport check–in counter for physical verification. The passenger name and credit card name should match. If there are multiple passengers booked on a PNR, at least one of the passengers should be the Credit Card holder. Passenger(s) who are unable to produce the physical credit card and/or the identity not matching with the credit card and photo identity will not be allowed to board the flight.
  31. SpiceJet permits the carriage of pets on its flights but booked through cargo services only.
  32. Spicy bite/combo purchased at the time of booking are non refundable.
  33. All new taxes/charges levied by the Government of India or any statutory body subsequent to the date of booking and applicable on the date of travel shall be charged and payable separately.

Denied Boarding, Flight Cancellation, Delay and Compensation

  1. Denied Boarding
    As a Policy, SpiceJet does not overbook its flight. However, in case of overbooked situation arising due to unavoidable situations (e.g. clubbing of flights etc.) resulting in passenger being denied boarding against their will, the compensation, as mentioned in clause (i) under the section "Flight Cancellations", shall be paid to the passenger(s) in addition to refund of air ticket.

    SpiceJet reserves the right to deny boarding to any passenger that is under the influence of alcohol or drugs, for health, safety or security reasons or in the absence of adequate travel documents and no compensation as referred above shall be payable in such cases.

  2. Flight Cancellations
    SpiceJet will make all reasonable efforts to ensure timely operations of its scheduled flights. However, due to unforeseen circumstances causing a delay or cancellation of its scheduled operations :

    SpiceJet shall endeavour to inform the passenger(s) about flight cancellation atleast three hours in advance through telephone call or SMS, provided the passenger(s) have given correct and working mobile number at the time of effecting the reservation.

    In respect of passenger(s) who have provided correct and working mobile number at the time of effecting the reservation and have not been informed at least three(3) hours in advance about the cancellation of the flight on which they were scheduled to travel, SpiceJet shall
    1. provide following financial compensation only if the amount of tickets price is higher than the compensation amount as below:
      1. Rs.2,000 or the value of the ticket whichever is less for flights having a block time of upto and including one hour.
      2. Rs.3,000 or the value of the ticket whichever is less for flights having block time of more than one hour and upto and including two hours.
      3. Rs.4,000 or the value of the ticket whichever is less for flights having a block time of more than two hours.

      If the cost of the ticket is less than the amount of compensation indicated above, the airline will be liable to compensate an amount equivalent to the ticket price. AND
    2. refund the ticket price to the passenger(s) in the event they do not wish to travel instead on any subsequent SpiceJet flight or on another carrier's flight or if so desired by the passengers, they shall be offered alternate travel opportunities at no additional cost. AND
    3. provide reasonable refreshments in the event they have already reported for their original flight and whilst they are waiting for the alternate flight / arrangement.

    No compensation as mentioned in this clause other than refund of tickets cost shall be payable to any of the affected passenger(s) in the event:

    • Adequate contact information ( i.e. mobile number) has not been provided by the passenger(s) at the time of effecting the reservation; or
    • Information about cancellation has been provided at least three (3) hours before scheduled / revised departure time; or
    • Passenger(s) do not accept the alternate travel arrangement made by SpiceJet including offer of seat on subsequent flights of SpiceJet or any other carrier; or
    • The cancellations occur due to force majeure event, the impact of which lead to cancellation of the flight and which could not have been avoided even if all reasonable measures had been taken by SpiceJet. For this purpose force majeure event shall mean, including, but without limitation, political instability, natural disaster, civil war, insurrection or riot, flood, explosion, government regulations or order affecting the aircraft, strikes and labour disputes causing cessation slowdown or interruption or work, meteorological conditions, mechanical failures, commotion, embargoes, cancellation/delays clearly attributable to Air Traffic Control, security /safety risks or any other factor that is beyond the control of SpiceJet.
  3. Flight Delays
    In case the passenger has checked in on time and SpiceJet expects delays as follows, it shall provide reasonable refreshments to such checked in passengers:.
    1. Delay of 2 hours or more from scheduled / revised departure time for flight having block time of upto two and a half hours;
    2. Delay of 3 hours or more from scheduled / revised departure time for flight having block time of more than two and a half hours and upto five hours;
    3. Delay of 4 hours or more from scheduled / revised departure time for flights not falling under sub-clause (i) and (ii) above.

    In case the expected time of departure due to delay is more than 24 hours hotel accommodation shall be provided wherever necessary. SpiceJet shall have absolute discretion in selection of hotels under the given circumstances and no reimbursement shall be made in this regard.

    No compensation as mentioned in this clause shall be payable to any of the affected passengers in the event such delay is caused due to force majeure event as mentioned hereinabove in section (b)

The compensation mentioned above under respective categories is not cumulative and cannot be clubbed together.

The above policies are governed by the Civil Aviation Requirements of Ministry of Civil Aviation, Government of India.

Definitions

"Baggage" means your personal property accompanying you on your trip. It consists of both your Checked Baggage and Cabin Baggage.

"Booking" (otherwise known as electronic ticket) means the details which we or out authorized agent have entered into our system relating to a journey.

"Cabin Baggage" (sometimes referred to as carry-on or unchecked baggage) means any of your Baggage other than Checked Baggage (You take your Cabin Baggage into the cabin of the aircraft with you.)

"Checked Baggage" means that part of your Baggage which we have taken into our custody for carriage in the hold of the aircraft and for which we have issued a baggage check.

"Guest" means any person with a Booking who is to be carried or who is carried on the aircraft, except members of the crew.

Conditions of Contract (International)

Article 1 - What particular expressions mean in these conditions As the Guest reads these conditions, please note that:

"GUEST" means any person, except members of the crew, carried or to be carried in an aircraft pursuant to a Ticket.
Flights are operated by Spicejet Limited.

"AGREED STOPPING PLACES" means those places, except the place of departure and the place of destination, set out in the Ticket or shown in the airlines’ timetables as scheduled stopping places on the Guest’s route.

"SPICEJET DESIGNATOR CODE" means the two characters or three letters which identify particular air carriers and in the case of "Spicejet Limited" will mean "SG".

"AUTHORISED AGENT" means a Guest sales agent who has been appointed by Spicejet to represent the airline in the sale of air transportation on its services.

"BAGGAGE" means the Guest’s personal property accompanying them in connection with their trip. Unless otherwise specified, it consists of both their Checked and Hand Baggage.

"BAGGAGE CHECK" means those portions of the Ticket which relate to the carriage of the Guest’s Checked Baggage.

"BAGGAGE IDENTIFICATION TAG" means a document issued solely for identification of Checked Baggage.

"CARRIER" means an air carrier other than Spicejet, whose designator code appears on the Guest’s Ticket or on a Conjunction Ticket.

"CHECKED BAGGAGE" means Baggage of which Spicejet takes custody and for which the airline has issued a Baggage Check.

"CHECK-IN DEADLINE" means the time limit specified by Spicejet by which the Guest must have completed check-in formalities and received their boarding pass.

"CONDITIONS OF CONTRACT" means those statements contained in or delivered with the Guest’s Ticket or Itinerary/Receipt, identified as such and which incorporate, by reference, these Conditions of Carriage and notices.

"CONVENTION" means whichever of the following instruments are applicable:
•the Convention for the Unification of Certain Rules Relating to International Carriage by Air, signed at Warsaw, 12 October 1929 (hereinafter referred to as the Warsaw Convention);
•the Warsaw Convention as amended at The Hague on 28 September 1955;
•the Warsaw Convention as amended by Additional Protocol No.1 of Montreal (1975);
•the Warsaw Convention as amended at The Hague and by Additional Protocol No.4 of Montreal (1975);
•the Montreal Convention (1999)

"DAMAGE" includes death, wounding, or bodily injury to a Guest, loss, partial loss or theft of or other damage to Baggage, arising out of or in connection with carriage or other services incidental thereto performed by Spicejet.

"DAYS" mean calendar days, including all seven days of the week; provided that, for the purpose of notification, the day upon which notice is dispatched shall not be counted; and provided further that for purposes of determining duration of validity of a Ticket, the day upon which the Ticket is issued, or the flight commenced shall not be counted.

"FORCE MAJEURE" means unusual and unforeseeable circumstances beyond Spicejet’s control, the consequences of which could not have been avoided even if all due care had been exercised.

"HAND BAGGAGE" means any of the Guest’s baggage other than Checked Baggage.

"ITINERARY/RECEIPT" means a document or documents Spicejet issues to Guests travelling on Electronic Tickets that contains the Guest's name, flight information and notices.

"STOPOVER" means a scheduled stop on the Guest’s journey, at a point between the place of departure and the place of destination.

"TARIFF" means the published fares, charges and/or related conditions of carriage of an airline filed, where required, with the appropriate authorities.

"TICKET" means either the document entitled "Guest Ticket and Baggage Check" or the Electronic Ticket, in each case issued by Spicejet or on its behalf, and includes the Conditions of Contract and notices.

Article 2 – Applicability

2.1
OVERRIDING LAW

These Conditions of Carriage are applicable unless they are inconsistent with Spicejet’s Tariffs or applicable law in which event such Tariffs or laws shall prevail.
If any provision of these Conditions of Carriage is invalid under any applicable law, the other provisions shall nevertheless remain valid.

2.2
CONDITIONS PREVAIL OVER REGULATIONS

Except as provided in these Conditions of Carriage, in the event of inconsistency between these Conditions of Carriage and any other regulations Spicejet may have, dealing with particular subjects, these Conditions of Carriage shall prevail.

Article 3 – Tickets

3.1
GENERAL PROVISIONS

3.1.1
Spicejet will provide carriage only to the Guest(s) named in the Ticket, and appropriate identification proof needs to be produced at the time of travel

3.1.2
Some Tickets are sold at discounted fares which may be partially or completely non-refundable. Guests should choose the fare best suited to their needs.

3.1.3
The Ticket is and remains at all times the property of the issuing carrier.

3.1.4
Spicejet is a ticket less Airline. Spicejet offers a printed itinerary with a reference number and the details of the reservations. An itinerary does not constitute a document of carriage. The Booking in Spicejet’s database is the primary record of carriage and in the event of any differences between the itinerary and the Booking in Spicejet’s database, the Booking will prevail.

3.1.5
Spicejet does not issue open tickets hence no period of validity is applicable to the ticket.

3.3
BOOKING AMENDMENT/CHANGES   AND CANCELLATION 

3.3.1
Changes/cancellation may be made to a booking unto 2 hours prior to the scheduled departure time of the booked flight.

3.3.2
Change of booking - change in flight date, time, origin, destination constitutes as change of booking.  A fee of INR750 equivalent local currency of the departure countryper Guest per one way would be charged for any changes. In addition to the change fee, the difference between the original and current applicable fare (if any) and any change in taxes, fees, surcharges are applicable. In case of the current available fares being lower than the original, balance funds will be retained in form of credit shell (ref 3.3.3

3.3.3
Cancellation of booking A fee of INR750 or equivalent local currency of the departure countryper Guest per one waywould be deducted towards the cancellation of the booking. The balance amount would be retained under the original PNR as a credit shell. The credit shell amount may be adjusted in any booking made with Spicejet up to a year from the date of cancellation. This amount is transferable and may be used for any booking for anyone known to the Guest. The Guest may opt for a refund of the credit shell amount within this period. Once expired the amount shall not be reinstated.

3.4
Spicejet offers an assortment of food and drink items for sale onboard. Payment for the same shall be accepted only in Dollars (USD) or Indian currency (INR).

3.5
Any Guest connecting to or from Spicejet flights from the domestic to the international route or vice versa would have to adhere to the following:

  • Spicejet would not be responsible for any delay due to immigration/custom clearance leading to a missed onward connection. The Guest may have to purchase a new ticket.
  • The boarding card for the final international leg of journey would be issued only at the last departing station.

Article 4 - Fares, Taxes, Fees and Charges

4.1
FARES

Fares apply only for carriage from the airport at the point of origin to the airport at the point of destination, unless otherwise expressly stated. Fares do not include ground transport service between airports and between airports and town terminals. The Guests’ fare will be calculated in accordance with Spicejet’s Tariff in effect on the date of payment for travel on the specific dates and itinerary shown on it.  Any change in the itinerary or dates of travel, may change the fare to be paid.

4.2
TAXES, DUTIES, FEES, CHARGES AND SURCHARGES
  
The amount of any applicable taxes, duties, fees, charges or surcharges payable by the Guest is calculated as at the date of Ticket issuance. If there is a change in an existing tax, duty, fee, charge or surcharge, or a new tax, duty, fee, charge or surcharge is imposed, after the date of Ticket issuance, the Guest will not be obliged to pay it or get a refund as the case may be, unless:
(a) The Guest decides to change the date of travel which requires rebooking of the ticket or
(b) The tax, duty, fee, charge, surcharge (including User Development Fee) is to be paid to or is on behalf of a regulatory authority.

4.3
CURRENCY
  
Fares, taxes, fees and charges are payable in the currency of the country in which the Ticket is issued, unless another currency is indicated by Spicejet or its Authorized Agent at or before the time  payment is made (for example, because of the non-convertibility of the local currency). Spicejet may, at its discretion, accept payment in another currency.

Article 5 – Reservations

5.1
RESERVATION REQUIREMENTS
  
5.1.1
Certain fares have conditions which limit or exclude the Guests’ right to change or cancel reservations.
  
5.1.2
Spicejet requests that at the point of reservation the Guest provides the airline or it’s Authorized Agent with a contact number (valid mobile number) for each city in the Guests’ itinerary including the applicable country and area codes. This will assist Spicejet with informing Guests of any irregularities with a flight on which they are booked.

5.2
PERSONAL DATA
  
The Guest recognizes that personal data has been given to Spicejet for the purposes of making a reservation, purchasing a Ticket, obtaining and for providing ancillary services or products that may be offered by Spicejet and/or its chosen partners from time to time, developing and providing services, facilitating immigration and entry procedures, and making available such data to government agencies, in connection with the guests’ travel. For these purposes, the guest authorizes Spicejet to retain and use such data and to transmit it to the airlines’ own offices, Authorized Agents, government agencies, other Carriers or the providers of the above-mentioned services. The Guest also recognizes that Spicejet and / or its chosen partners may contact them via email or other means to inform them of account status or changes or alterations to the service, or to inform them of other services provided or contemplated.

5.3
SEATING
  
Seating will ordinarily be initially assigned through advance reservation where available or during the check-in process at the airport for flights operated by Spicejet. Spicejet   will endeavor to honor advance seating requests. However, the airline cannot guarantee any particular seat. Spicejet reserves the right to assign or reassign seats at any time, even after boarding of the aircraft. This may be necessary for operational, safety or security reasons

5.4
FAILURE TO REPORT FOR FLIGHT

Check–in closes 1 hour prior to the departure of the flight. Failure to complete the check in formalities within the stipulated time limit would result in forfeiture of the ticket amount. The ticket would be declared a No Show and the Guest would not be entitled to a refund or a credit shell. However, only the PSF and UDF may be refunded upon request by the passenger by writing to Spicejet on the designated email id: custrelations@spicejet.com

Article 6 - Check-In and Boarding

6.1
Spicejet recommends that Guests report for Check-in at least 3 hours prior to the departure of the scheduled flight. The Guest’s journey will be smoother if they allow themselves ample time to comply with the Check-in Deadlines. Spicejet reserves the right to cancel a Guest’s reservation if they do not comply with the Check-in Deadlines indicated. Spicejet or its Authorized Agents will advise Guests of the Check-in Deadline. Check-in closes 01 hour prior to the scheduled departure of the flight.

It is advisable to reach the airport and check-in at the earliest possible to avoid any rush or inconvenience.

6.2
The Guest must be present at the boarding gate not later than the time specified by Spicejet when they check in.

6.3
If Guests are travelling together as part of a group of 40 or more, it is advised to arrive at least an additional 30 minutes in advance of the time advised to report to the airport prior to the flight departure.

6.4
Guests may also check-in online provided they fulfill the following conditions:

6.4.1
Web check-in starts 24 hours prior to the departure time and closes 4 hours prior to the departure time of the scheduled flight.

Guests opting for web check-in are permitted to carry only one piece of Hand Baggage, not weighing more than 10 kg the dimensions of which should not exceed 115 cm (55cm + 35cm + 25cm). Checked baggage allowance would not be extended to web check-in Guests.

6.4.2
Once the Guest has checked-in online, no modifications (changes or cancellation) would be permitted to that particular leg of their journey.

6.4.3
A Guest may check-in online if and only if they have not opted for a special service request such as Infant(s), Wheelchair(s) or Unaccompanied Minor(s)

6.5
Spicejet will cancel the space reserved for the Guest if they fail to arrive at the boarding gate in time.

6.6
Spicejet will not be liable to the Guest for any loss or expense incurred due to their failure to comply with the provisions of this Article.

Article 7 - Refusal and Limitation of Carriage

7.1
RIGHT TO REFUSE CARRIAGE
  
In the reasonable exercise of Spicejets’ discretion, the airline may refuse to carry the Guest or their Baggage if the Guest has been notified in writing that Spicejet would not at any time after the date of such notice carry them on its flights. In this circumstance the Guest will be entitled to a full refund. Spicejet may also refuse to carry the Guest or their Baggage if one or more of the following have occurred or the airline reasonably believes may occur:
  
7.1.1
Such action is necessary in order to comply with any applicable government laws, regulations, or orders;
  
7.1.2
The carriage of the Guest or their Baggage may endanger or affect the safety, health, or materially affect the comfort of other Guests or crew;
  
7.1.3
The Guest’s mental or physical state, including their impairment from alcohol or drugs, presents a hazard or risk to themselves, to Guests, to crew, or to property;
  
7.1.4
The Guest has refused to submit to a security check;
  
7.1.5
The Guest has not paid the applicable fare, taxes, fees or charges;
  
7.1.6

  • The Guest does not appear to have valid travel documents, may seek to enter a country through which they may be in transit, or for which they do not have valid travel documents, destroy their travel documents during flight or refuse to surrender their travel documents to the flight crew, against receipt, when so requested;
  • If the immigration authority for the country the Guest is traveling to, or for a country in which they have a stopover, has told the airline(either orally or in writing) that it has decided not to allow them to enter that country, even if they have or appear to have, valid travel documents;

  
7.1.7

The Guest presents a Ticket that has been acquired unlawfully, has been purchased from an entity other than Spicejet or Authorized Agent, or is a counterfeit, or the Guest cannot prove that they are the person named in the Ticket;   

7.1.8
The Guest presents a Ticket which has been issued or altered in any way, other than by Spicejet or its Authorized Agent

7.1.9
The Guest fails to observe Spicejet’s instructions with respect to safety or security;
  
7.1.10
The Guest has refused or failed to undergo health screening or a health examination requested by Spicejet or by a government enforcement agency;
  
7.1.11
The Guest has failed to complete the Check-In Deadline or failed to arrive at the boarding gate on time.
  
7.1.12
The Guest has previously committed one of the acts or omissions referred to above, and Spicejet has reason to believe that they may do so again.

7.2
SPECIAL ASSISTANCE

Acceptance for carriage of unaccompanied children, incapacitated persons, pregnant women, and persons with illness or other people requiring special assistance is subject to prior arrangement with Spicejet. Guests with disabilities, who have advised Spicejet of any special requirements they may have at the time of ticketing, and have been accepted by the airline, shall not subsequently be refused carriage on the basis of such disability or special requirements.

7.2.1 
Spicejet would like to know if Guests have additional needs, so that the airline can provide them with the necessary assistance throughout their journey. If the Guest is a senior citizen, has faced any temporary accident, has undergone surgery or requires to take post surgery precautions, has reduced mobility due to any kind of Physical disability (sensory or locomotor, permanent or temporary) and if there is any intellectual impairment , Spicejet makes adequate provision for wheelchair assistance .

  • If the Guest needs wheelchair assistance at the airport, please request Spicejet   at least 24 hours in advance. Please call the Guest Sales & Reservation Center and inform Spicejet’s staff of the Guest’s requirements. The inventory is limited to 4 per flight.
  • Spicejet allows only Manual / Collapsible Wheelchairs on all its flights. Powered wheelchair with a wet cell battery shall not be accepted. However, powered wheelchairs with non spillable battery (terminals disconnected, insulated and sealed) may be carried on Spicejet’s aircraft.
  • If the Guest wishes to use their own wheelchair at the airport, they are permitted to do so up to the aircraft, whereupon it will be stored in the overhead bin or under the seat (if collapsible).

7.2.2
If the Guest is not self-reliant (capable of taking care of all their physical needs independently in-flight) e.g. eating, drinking, using the lavatory or administering/ withholding medications. Spicejet requests them to travel with a ticketed companion who can assist them.
Medical Clearance will be required only when Spicejet has received prior information from the Guest or an escort that the Guest:

  • Suffers from any disease, which is believed to be actively contagious and communicable.
  • Who, because of certain disease, or incapacitation may have developed an adverse physical condition which could have an adverse effect during the flight and on safety and emergency evacuation procedures.
  • Would require medical attention and / or special equipment to maintain their health during the flight.
  • There exists a possibility of aggravation of the Guest’s medical condition during or because of the flight.

7.2.3
At the time of booking or at the check in counter, visually impaired Guests must request for special service for assistance at the airport.
Incubators and Guide Dogs for the blind are not allowed on Spicejet flights due to constraints in the aircraft interior.
7.2.4
Spicejet will accept children aged between 5-12 years traveling alone as unaccompanied children.

  • Spicejet does not charge any fee for this service.
  • It is mandatory to produce photo identification at the airport for all unaccompanied minors.
  • Guests should complete and sign an Unaccompanied Minor Form at the departing airport, Spicejet will take charge of their custody and on arrival the airline requires designated recipient to show identification and sign for the unaccompanied minor’s custody.
  • During the trip the child would be escorted by Spicejet’s staff throughout the airport procedures and seated in the aircraft where the In-flight personnel will keep a watchful eye on them.
  • Guests above the age of 12 will be expected to travel alone.

7.2.5
Expectant mothers may travel up to and including the 27 weeks of their pregnancy, and will be accepted between the 28 to 35 weeks only if they are in possession of a doctor's certificate confirming the stage of their pregnancy and stating that they are fit to fly. Expectant mothers 36 weeks and above are not allowed to fly on Spicejet flights.
7.2.6
Guests traveling with infants are requested to specify the same at the time of booking. In case they fail to do so they may call the Guest Sales and Reservations number before their date of travel and Spicejet’s staff will assist them with the booking. Applicable charges would be levied per sector towards the infant’s booking. Due to limited inventory for accommodating infants per flight, Guest’s are requested to follow the above mentioned procedure when booking children below 2 years of age. A maximum of one Infant is allowed per adult. No baby/car seats or push chairs are allowed in the aircraft cabin. No extra seats may be booked for Infants, and Infants do not qualify for a free Baggage allowance. Proof of age is required, so please have the Infant's valid photo-ID available for inspection.

7.2.7

There is no charge for transporting any assistive device, which the Guest may require, such as a wheelchair or a cane, and such assistive devices will not be counted towards the Guest’s free Baggage allowance.

7.2.8

On flights where medical oxygen is permitted, the Guest will be charged for the service of medical oxygen (and they will be required to be accompanied by an attendant) with prior notice of 24hrs and subject to approval by Spicejet.

Currently Spicejet does not have provisions for accommodating stretchers, human remains and pets hence carriage of the same is not permitted.

8.1
CHECKED BAGGAGE

8.1.1
Spicejet allows free Checked baggage up to 20kgs per adult and child (any guest above 2 yrs of age). The dimensions of the checked baggage should not to exceed 158 cm (62 inches) in overall dimensions (L+W+H). A flat rate of 100 per kg (or currency equivalent) would be charged towards excess baggage. 

• Spicejet does not have a limit on the number of bags; however each bag must not exceed 32kg as per airport baggage restriction.

8.1.2
Upon delivery to Spicejet of the Guest’s Baggage which they wish to check, Spicejet will take custody of, and issue a Baggage Identification Tag for, each piece of Checked Baggage

8.1.3      
Checked Baggage must have the Guest’s name or other personal identification affixed to it.

8.1.4
Checked Baggage will, whenever possible, be carried on the same aircraft as the Guest, unless Spicejet decides for safety, security or operational reasons to carry it on an alternative flight. If the Checked Baggage is carried on a subsequent flight Spicejet will deliver it to the Guest, unless applicable law requires the Guest to be present for customs clearance.

8.2
HAND   BAGGAGE

8.2.1
Unless otherwise advised by Spicejet, only one piece of Hand Baggage per Guest will be allowed. The dimensions of the Hand Baggage should not exceed (L+B+H) – 55cm+35cm+25cm totaling 115cms (45 inches).The hand baggage allowance is 10 kg per adult and child (any guest above 2 yrs of age) .Strolley bags with the above specified dimensions will be allowed .

Less than 20kgs of check-in baggage does not qualify for the difference of weight in handbaggage and vice versa

8.2.2

Articles, which may be carried free in addition to the Baggage allowance (subject to applicable security regulations), are:-

  • An overcoat wrap or blanket.
  • An umbrella or walking stick.
  • A lady's handbag, lady's pocket-book or lady's purse.
  • A reasonable amount of reading matter for the flight.
  • A small camera and/or a pair of binoculars.
  • Infant's food for consumption in flight.
  • A fully collapsible invalid's wheelchair and/or a pair of crutches and/or braces or other prosthetic device for the Guest's use.

8.2.3
Spicejet may specify other maximum dimensions and/or weight for Hand Baggage. If Spicejet has not done so, except as specified in 8.2.1, Hand Baggage which the Guest carries onto the aircraft must fit under the seat in front or in an enclosed storage compartment in the cabin of the aircraft. If the Guest’s Hand Baggage cannot be stored in this manner, or is of excessive weight, or is considered unsafe for any reason, it must be carried as Checked Baggage, subject to Articles 8.6 and 8.7.

8.2.4
Objects not suitable for carriage in the cargo compartment (such as delicate musical instruments), and which do not meet the requirements in Article 8.2.1 and Article 8.2.2 above, will only be accepted for carriage in the cabin compartment if the Guest has given us notice in advance and permission has been granted by Spicejet. Guests may be required to pay a separate charge for this service.

8.3
ITEMS UNACCEPTABLE AS BAGGAGE

8.3.1
Following articles/items must not be included in the Guest’s Baggage:

8.3.1.1
Items which are likely to endanger the aircraft or persons or property on board the aircraft, such as those specified in the International Civil Aviation Organization (ICAO) Technical Instructions for the Safe Transport of Dangerous Goods by Air and the International Air Transport Association (IATA) Dangerous Goods Regulations, and in Spicejet’s regulations. Further information is available from Spicejet   on request although illustrative examples include:
• Compressed gases (deeply refrigerated, flammable, non-flammable and poisonous), such as butane, oxygen, liquid nitrogen, aqualung cylinders and compressed gas cylinders such as camping gas.
• Corrosives such as acids, alkalis, mercury and wet cell batteries and apparatus containing mercury.
• Explosives, munitions, fireworks and flares, blank cartridges, pistols or any other weapons and pistol caps.
• Flammable liquids and solids such as lighter refills, lighter fuel, matches, paints, thinners, fire-lighters, lighters that need inverting before ignition, substances liable to spontaneous combustion, substances which emit flammable gases on contact with water.
• Radioactive materials
• Briefcases and attaché cases with installed alarm or pyrotechnic devices.
• Oxidizing materials such as bleaching powder and peroxides.
• Poisons and infectious substances such as insecticides, weed-killers and live virus materials.
• Other dangerous articles such as magnetized materials, offensive or irritating materials.

8.3.1.2.
Items the carriage of which is prohibited by the applicable laws, regulations or orders of any state to be flown from or to;

8.3.1.3
Items which are reasonably considered by Spicejet to be unsuitable for carriage because they are dangerous or unsafe, or because of their weight, size, shape or character, or because they are fragile or perishable having regard to, among other things, the type of aircraft being used. Information about unacceptable items is available upon request.

8.3.2
Firearms and ammunition other than for hunting and sporting purposes are prohibited from carriage as Baggage. Firearms and ammunition for hunting and sporting purposes may be accepted as Checked Baggage. Firearms must be unloaded, with the safety catch on, and suitably packed. Carriage of ammunition is subject to ICAO and IATA regulations as specified in Article

8.3.3
Dry cell batteries, scissors, sharp instruments, tools, weapons such as antique firearms, toy weapons, swords, knives and similar items may be accepted as Checked Baggage, at Spicejet’s sole discretion, but will not be permitted in the cabin of the aircraft.

8.3.4
The Guest must not include in Checked Baggage money, currency, jewellery, precious metals, computers, personal electronic devices, negotiable papers or instruments, securities or other valuables, business documents, passports and other identification documents or samples. To the extent that it is necessary to carry such items (at the Guest’s risk), they should be carried in the Guest’s Hand Baggage in the cabin.

8.3.5
Medicines and toiletries may be carried in limited quantities, which are necessary or appropriate during the Guest’s journey (to the extent that carriage is permitted by the appropriate regulations). Otherwise, many of these items can be carried as air cargo provided they are packed in accordance with cargo regulations.

8.3.6
If, despite being prohibited, any items referred to in Articles 8.3.1, 8.3.2 and 8.3.4 are included in the Guest’s Baggage, Spicejet shall not be responsible for any loss or damage to such items.

8.4
RIGHT TO REFUSE CARRIAGE

8.4.1
Subject to Articles 8.3.2, 8.3.3, 8.3.4 and 8.3.5 Spicejet will refuse to carry as Baggage the items described in Article 8.3, and Spicejet may refuse further carriage of any such items upon discovery.

8.4.2
Spicejet may refuse to carry as Baggage any item reasonably considered by the airline to be unsuitable for carriage because of its size, shape, weight, content or character, or for safety or operational reasons, or in the interests of the comfort of other Guests. Information about unacceptable items is available upon request.

8.4.3
Spicejet may refuse to accept Baggage for carriage unless it is in the airlines’ reasonable opinion properly and securely packed in suitable containers. Information about packing and containers unacceptable to Spicejet is available upon request.

8.5
RIGHT OF SEARCH
For reasons of safety and security Spicejet may request that the Guest permit a search and scan of their person and a search, scan or x-ray of their Baggage. If the Guest is not available, their Baggage may be searched in their absence for the purpose of determining whether they are in possession of or whether their Baggage contains any item described in Article 8.3.1  or 8.3.4 or any firearms, ammunition or weapons which have not been presented to Spicejet in accordance with Articles 8.3.2 or 8.3.3. If the Guest is unwilling to comply with such request Spicejet may refuse to carry them and their Baggage. In the event a search or scan causes Damage to the Guest, or an x-ray or scan causes damage to their Baggage, Spicejet shall not be liable for such Damage unless due to the airlines’ fault or negligence.

8.6
COLLECTION AND DELIVERY OF CHECKED BAGGAGE

8.6.1
Subject to Article 8.1.4, the Guest is required to collect their Checked Baggage as soon as it is made available at their destination or Stopover. Should the Guest not collect it within a reasonable time, Spicejet may charge them a storage fee. Should the Guest’s Checked Baggage not be claimed within three (3) months of the time it is made available, Spicejet may dispose of it without any liability to them.

8.6.2
Only the bearer of the Baggage Check and Baggage Identification Tag is entitled to delivery of the Checked Baggage.

8.6.3
If a person claiming Checked Baggage is unable to produce the Baggage Check and identify the Baggage by means of a Baggage Identification Tag, Spicejet will deliver the Baggage to such person only on condition that he or she establishes to Spicejet’s satisfaction his or her right to the Baggage.

8.6.4
Spicejet does not accept responsibility for the transfer of baggage to other flights.

8.7
ITEMS REMOVED BY AIRPORT SECURITY PERSONNEL

Spicejet will not be responsible for, or have any liability in respect of, articles removed from the Guest’s Baggage by airport security personnel acting in accordance with any applicable regulations.

Article 9 - Schedules, Delays, Cancellation of Flights

9.1
SCHEDULES

• The flight times shown in timetables may change between the date of publication and the date the Guest actually travels. Spicejet does not guarantee them to the Guest and these do not form part of their contract with us.
• Before Spicejet accepts The Guest’s booking, Spicejet will notify the Guest of the scheduled flight time in effect as of that time, and it will be shown on their Ticket. It is possible Spicejet may need to change the scheduled flight time subsequent to issuance of the Guest’s Ticket. The Guest needs to provide us with contact information (valid mobile number); Spicejet will endeavour to notify Guests of any such changes. If, after purchase of the ticket, Spicejet makes a significant change to the scheduled flight time, which is not acceptable to the Guest, and Spicejet is unable to book them on an alternate flight which is acceptable to them, they will be entitled to a refund in accordance with Article 10.

9.2

DENIED BOARDING, FLIGHT CANCELLATION, DELAY AND COMPENSATION

9.2.1
Denied Boarding
As a Policy, Spicejet does not overbook its flight. However, in case of overbooked situation arising due to unavoidable situations (e.g. clubbing of flights etc.) resulting in passenger being denied boarding against their will, the compensation, as mentioned in clause (i) under the section "Flight Cancellations", shall be paid to the passenger(s) in addition to refund of air ticket.

Spicejet reserves the right to deny boarding to any passenger that is under the influence of alcohol or drugs, for health, safety or security reasons or in the absence of adequate travel documents and no compensation as referred above shall be payable in such cases.

9.2.2
Flight Cancellations

Spicejet will make all reasonable efforts to ensure timely operations of its scheduled flights. However, due to unforeseen circumstances causing a delay or cancellation of its scheduled operations:

Spicejet shall endeavor to inform the passenger(s) about flight cancellation atleast three hours in advance through telephone call or SMS, provided the passenger(s) have given correct and working mobile number at the time of effecting the reservation.

In respect of passenger(s) who have provided correct and working mobile number at the time of effecting the reservation and have not been informed at least three(3) hours in advance about the cancellation of the flight on which they were scheduled to travel, Spicejet shall

9.2.2.1
Provide following financial compensation only if the amount of tickets price is higher than the compensation amount as below:

  • Rs.2,000 or the value of the ticket whichever is less for flights having a block time of up to and including one hour.
  • Rs.3,000 or the value of the ticket whichever is less for flights having block time of more than one hour and up to and including two hours.
  • Rs.4,000 or the value of the ticket whichever is less for flights having a block time of more than two hours.

If the cost of the ticket is less than the amount of compensation indicated above, the airline will be liable to compensate an amount equivalent to the ticket price. AND

9.2.2.2
Refund the ticket price to the passenger(s) in the event they do not wish to travel instead on any subsequent Spicejet flight or on another carrier’s flight or if so desired by the passengers, they shall be offered alternate travel opportunities at no additional cost. AND

9.2.2.3
Provide reasonable refreshments in the event they have already reported for their original flight and whilst they are waiting for the alternate flight / arrangement.

No compensation as mentioned in this clause other than refund of tickets cost shall be payable to any of the affected passenger(s) in the event:

  • Adequate contact information ( i.e. mobile number) has not been provided by the passenger(s) at the time of effecting the reservation; or
  • Information about cancellation has been provided at least three (3) hours before scheduled / revised departure time; or
  • Passenger(s) do not accept the alternate travel arrangement made by Spicejet including offer of seat on subsequent flights of Spicejet or any other carrier; or
  • The cancellations occur due to force majeure event, the impact of which lead to cancellation of the flight and which could not have been avoided even if all reasonable measures had been taken by Spicejet. For this purpose force majeure event shall mean, including, but without limitation, political instability, natural disaster, civil war, insurrection or riot, flood, explosion, government regulations or order affecting the aircraft,  strikes and labor disputes causing cessation slowdown or interruption or work, meteorological conditions, mechanical failures, commotion, embargoes, cancellation/delays clearly attributable to Air Traffic Control, security /safety risks or any other factor that is beyond the control of Spicejet.

9.2.3
Flight Delays
Incase the passenger has checked in on time and Spicejet expects delays as follows, it shall provide reasonable refreshments to such checked in passengers:.

9.2.3.1
Delay of 2 hours or more from scheduled / revised departure time for flight having block time         of up to two and a half hours;

9.2.3.2
Delay of 3 hours or more from scheduled / revised departure time for flight having block time   of more than two and a half hours and up to five hours;

9.2.3.3
Delay of 4 hours or more from scheduled / revised departure time for flights not falling under sub-clause 9.2.3.1 and 9.2.3.2 above.

In case the expected time of departure due to delay is more than 24 hours hotel accommodation shall be provided wherever necessary. Spicejet shall have absolute discretion in selection of hotels under the given circumstances and no reimbursement shall be made in this regard.

No compensation as mentioned in this clause shall be payable to any of the affected passengers in the event such delay is caused due to force majeure event as mentioned hereinabove in section (9.2.2)

The compensation mentioned above under respective categories is not cumulative and cannot be clubbed together.

The above policies are governed by the Civil Aviation Requirements of Ministry of Civil Aviation, Government of India.

Article 10 – Refunds

10.1
Spicejet will refund a Ticket in accordance with the applicable fare rules.

  
10.2
CURRENCY

Spicejet reserves the right to make a refund in the same manner and the same currency used to pay for the Ticket.

10.3
BY WHOM TICKET REFUNDABLE

Ticket refund will be the same as point of sale.

Article 11 - Conduct aboard aircraft

11.1
GENERAL

11.1.1
If, in Spicejet’s reasonable opinion, a Guest conducts himself aboard the aircraft so as to endanger the aircraft or any person or property on board, or obstruct the crew in the performance of their duties, or fail to comply with any instructions of the crew, including but not limited to those with respect to smoking, alcohol or drug consumption, or behave in a manner which causes discomfort, inconvenience, damage or injury to other Guests or the crew, Spicejet may take such measures as Spicejet deems reasonably necessary to prevent continuation of such conduct, including restraint. That Guest may be disembarked and refused onward carriage at any point, and may be prosecuted for offences committed on board the aircraft.

11.2
PAYMENT OF DIVERSION COSTS

If, as a result of conduct by a Guest of the sort mentioned in Article 11.1 Spicejet decides, in the exercise of Spicejet’s reasonable discretion, to divert the aircraft for the purpose of offloading that Guest, the Guest must pay all costs resulting from that diversion.

11.3
ELECTRONIC DEVICES

For safety reasons, Spicejet may forbid or limit operation aboard the aircraft of electronic equipment, including, but not limited to, cellular telephones, laptop computers, portable recorders, portable radios, CD players, electronic games or transmitting devices, including radio controlled toys and walkie-talkies. Operation of hearing aids and heart pacemakers is permitted.

11.4
NON-SMOKING AND ALCOHOL

In order to comply with certain local regulations in various states, smoking on flights and/or the consumption of alcohol on flights may be prohibited. As a separate precautionary measure, all toilets are also fitted with smoke detectors.

Article 12 - Administrative formalities

12.1
GENERAL

12.1.1
The Guest is responsible for obtaining all required travel documents and visas and for complying with all laws, regulations, orders, demands and travel requirements of countries to be flown from, into or through which they transit.

12.1.2
Spicejet shall not be liable for the consequences to any Guest resulting from their failure to obtain such documents or visas or to comply with such laws, regulations, orders, demands, requirements, rules or instructions

12.2
TRAVEL DOCUMENTS

Prior to travel, the Guest must present all exit, entry, health and other documents required by law, regulation, order, demand or other requirement of the countries concerned, and permit Spicejet to take and retain copies thereof. Spicejet reserves the right to refuse carriage if the Guest does not comply with these requirements, or their travel documents do not appear to be in order.

12.3
REFUSAL OF ENTRY

If the Guest is denied entry into any country, they will be responsible to pay any fine or charge assessed against Spicejet by the Government concerned and for the cost of transporting them from that country. The fare collected for carriage to the point of refusal or denied entry will not be refunded by Spicejet  
.
12.4
GUEST RESPONSIBLE FOR FINES, DETENTION COSTS, ETC.

If Spicejet is required to pay any fine or penalty or incurs any expenditure by reason of the Guest’s failure to comply with laws, regulations, orders, demands or other travel requirements of the countries concerned or to produce the required documents, the Guest shall reimburse Spicejet   on demand any amount so paid or expenditure so incurred. Spicejet may apply towards such payment or expenditure the value of any unused carriage on the Guest’s ticket, or any of the Guest’s funds in Spicejets’ possession.

12.5
CUSTOMS INSPECTION

If required, the Guest shall attend inspection of their Baggage, by customs or other Government officials. Spicejet will not be liable to the Guest for any loss or damage suffered by them in the course of such inspection or through their failure to comply with this requirement.

12.6
SECURITY INSPECTION

The Guest shall agree to any security checks by Governments, airport officials, Carriers or by Spicejet.

13.1
APPLICABILITY
13.1.1
The liability of each carrier involved in the Guest’s journey will be determined by its own conditions of carriage. Spicejets’ liability provisions are as follows:

13.2
APPLICABLE RULES
13.2.1
The rules applicable to Spicejet’s liability shall be as provided by:
• The Convention, to the extent it applies; and
• To the extent not inconsistent with the above, applicable national law.

13.3
DEATH OF OR INJURY TO GUESTS

13.3.1
There shall be no artificial limit to the amount of Spicejet’s liability for death, wounding or bodily injury suffered by a Guest in the event of an accident on board the aircraft or in the course of embarking or disembarking.

13.3.2
In the event of death of a passenger, or any bodily injury or wound suffered by a passenger which results in a permanent disablement incapacitating him from engaging in or being occupied with his usual duties or business occupation, the liability of the Carrier for each passenger shall be INR 750,000 only if the passenger is 12 years or more of age and INR 375,000 if the passenger is below 12 years of age on the date of the accident.

13.3.4
Notwithstanding the provisions of Article 13.3.2, if Spicejet proves that the damage was caused by, or contributed to by, the negligence of the injured or deceased Guest, Spicejet may be exonerated wholly or partly from Spicejet’s liability in accordance with applicable law.

13.3.5
Spicejet is not responsible for any illness, injury or disability, including death, attributable to the guest’s physical condition or for the aggravation of such condition.

13.4
BAGGAGE
13.4.1
Except in the case of an act or omission done with intent to cause damage or recklessly and with knowledge that damage would probably result, Spicejet’s liability in the case of damage to Baggage shall be limited to INR 200 per Kg up to a maximum of INR 3000 only or equivalent local currency of the arrival country.

Provided that if in accordance with applicable law different limits of liability are applicable such different limits shall apply. If the weight of the Guest’s Checked Baggage is not recorded on the baggage check, it is presumed that the total weight of the Checked Baggage does not exceed the applicable free baggage allowance.

13.4.2
Spicejet will not be liable for damage to Hand Baggage unless such damage is caused by Spicejet’s negligence.

13.4.3
Spicejet is not liable for any damage caused by the Guest’s Baggage. The Guest shall be responsible for any damage caused by the Guest’s Baggage to other persons or property, including Spicejet’s property.

13.4.4
Spicejet shall have no liability whatsoever for damage to articles not permitted to be contained in Checked Baggage under Article 8.3, including fragile or perishable items, items having a special value, such as money, jewellery, precious metals, computers, personal electronic devices, negotiable papers, securities, or other valuables, business documents, passports and other identification documents, or samples

13.5
GENERAL

13.5.1
If Spicejet issues a ticket or if Spicejet checks Baggage for carriage on another carrier, the airline does so only as agent for the other Carrier. Nevertheless, with respect to Checked Baggage, the Guest may make a claim against the first or last Carrier.

13.5.2
Spicejet is not liable for any damage arising from Spicejets’ compliance with or the Guest’s failure to comply with applicable laws or Government rules and regulations.

13.5.3
Except as may be specifically provided otherwise in these Conditions of Carriage or by applicable law, Spicejet shall be liable to the Guest only for recoverable compensatory damages for proven losses.

13.5.4
The contract of carriage, including these Conditions of Carriage and exclusions or limits of liability, applies to Spicejet’s authorized agents, servants, employees and representatives to the same extent as it and they apply to Spicejet. The total amount recoverable from Spicejet and from such authorized agents, employees, representatives and persons shall not exceed the amount of Spicejet’s own liability, if any.

13.5.5
Nothing in these Conditions of Carriage shall waive any exclusion or limitation of Spicejet’s liability under the applicable laws unless otherwise expressly stated.

13.5.6
Nothing in these Conditions of Carriage shall waive any exclusion or limitation of Spicejet’s liability or any defense available to Spicejet    under applicable laws as against any public social insurance body or any person who is liable to pay compensation or has paid compensation in respect of the death, wounding or other bodily injury of a Guest.

Article 14 - Time limitation on claims and actions

14.1
LIMITATION OF ACTIONS

Spicejet is not liable for any loss or damage occasioned by delay in the carriage by air of Guests or baggage. Receipt without complaint of registered baggage on the termination of the journey shall be prima facie evidence that the baggage has been delivered correctly and in good condition.

Article 15 - Other conditions

Carriage of the Guest and their Baggage is also provided in accordance with certain other regulations and conditions applying to or adopted by Spicejet. These regulations and conditions as varied from time to time are important. They concern among other things:

(i)The carriage of unaccompanied minors, pregnant women, and sick Guests
(ii) Restrictions on use of electronic devices and items
(iii) The on board consumption of alcoholic beverages.

Regulations concerning these matters are available from the airline upon request.

Article 16- Credit card payment for International Ticket

Bookings made with credit cards which are issued at a country other than the destination or origin country are subject to physical verification at the airport during check-in. The credit card holder necessarily needs to be part of the traveling party .e.g.:for a Guest traveling from Colombo to India is traveling on a booking for which the payment was made using a credit card issued in USA. This credit card needs to be presented at the time of check-in
